L’assurance responsabilité civile médicale professionnelle obligatoire fait augmenter les taux de césariennes, accroît la rentabilité des poursuites judiciaires et fait chuter le nombre de naissances prévues à domicile.

L’obligation légale pour les sages-femmes pratiquant les accouchements à domicile de souscrire une assurance responsabilité civile professionnelle médicale a deux conséquences: rendre les poursuites judiciaires plus lucratives et faire diminuer le nombre de sages-femmes pratiquant les accouchements à domicile.

L’assurance responsabilité civile professionnelle médicale obligatoire a pour conséquence l’augmentation des poursuites judiciaires, ce qui a pour effet de faire augmenter les taux de morbidité et de mortalité maternelle en encourageant une politique de médecine défensive à l’intention des femmes dont les grossesses sont normales. Rien ne démontre que l’assurance responsabilité civile professionnelle médicale obligatoire ait un impact sur l’amélioration des conditions de la naissance ni sur la santé publique.

Abstract (English)  :

Making malpractice insurance mandatory by law for homebirth midwives serves two purposes: to make lawsuits more profitable and to decrease the number of homebirth midwives. Malpractice insurance has encouraged and increased number of lawsuits, which increases maternal morbidity and mortality rates by promoting the practice of “defensive medicine“ on healthy women experiencing normal pregnancies. No evidence shows that mandatory malpractice insurance has any effect on improvement birth outcomes or public health.
