Points essentiels
Le progrès médical scientifique a modifié l’état d’esprit de la société : la guérison doit toujours être obtenue et la complication d’un acte médical ou d’un traitement est assimilée à une faute.

En l’absence de faute professionnelle reconnue par l’expertise, la responsabilité est retenue souvent sur des arguties juridiques et non sur des comportements médicaux éthiquement critiquables.

L’accroissement des procédures judiciaires risque de conduire le corps médical à se protéger juridiquement, et les conséquences pour les malades de ce repli ne doivent pas être sous-estimées.

L’amélioration considérable de la santé de la population est due à des médicaments, des interventions ou des démarches de plus en plus efficaces, mais l’augmentation d’efficacité s’accompagne d’un risque accru d’effets secondaires ou de complications imprévisibles.

L’indemnisation de l’aléa thérapeutique permettrait de réduire la judiciarisation si son application était généralisée et dégagée de la recherche de responsabilité, la procédure civile ou pénale restant attachée à la faute professionnelle caractérisée.

Abstract (English)  :

cientific progress has modified the meaning of medical liability: Total recovery is considered the standard result, and side effects or harm are considered to be malpractice.

When medical experts find no errors, liability may be based on legal technicalities despite the absence of any ethically wrong behavior.

The increase in lawsuits may well lead to the practice of defensive medicine, despite the negative effects for patients of this approach.

The substantial improvements in public health are due to ever better drugs, diagnostic methods, and treatments, but this increasing effectiveness is associated with an increased risk of side effects or unpredictable complications.

Indemnification for unforeseeable complications should reduce the number of lawsuits if applied generally and separated from the concept of liability. Civil and criminal procedures would remain available for cases of real malpractice.
