L’objectif de l’analyse de dossiers de plaintes en responsabilité médicale, au sein de recommandations professionnelles concernant les extractions instrumentales, est de mettre en exergue les difficultés les plus fréquentes rencontrées par les obstétriciens, et de discuter certains points au vu de la littérature. Après avoir replacé le contexte par un rappel de la méthodologie et de quelques résultats d’une enquête non encore publiée sur la place de l’extraction instrumentale sur 239 337 accouchements en France en 2007, l’analyse de 61 dossiers d’implications en responsabilité médicale dans le cadre d’extraction instrumentale dans la période 1995-2007 est détaillée et les principales constatations sont reprises de façon synthétique dans un but didactique. Quelques points spécifiques aux discussions d’expertise font l’objet d’une argumentation de la littérature sur le sujet comme : l’intérêt des entretiens de débriefing après intervention obstétricale ; les discussions autour du délai écoulé pour prendre une décision de l’extraction instrumentale ainsi que le délai décision d’extraction naissance. Dans ce chapitre, différents aspects de la gestion des risques en salle d’accouchement sont abordés, en insistant plus particulièrement sur l’intérêt du relevé d’indicateurs de qualité, et les problématiques de formation incluant la formation par simulateur informatisé.

Abstract (English)  :

The aim of this data analysis on medical liability in professional guidelines on instrumental delivery, is to point out the most common difficulties to which obstetricians are exposed, and to discuss some aspects confronted to literature. Firstly, instrumental delivery is replaced in whole labour ward activity by unpublished results of a national enquiry on instrumental delivery concerning 239 337 deliveries during the year 2007. Then, the analysis of 61 data from legal claims in relation with instrumental deliveries between 1995 and 2007, to allow educational lessons. At last, few specific aspects of judicial expert opinion are confronted to literature and discussed: the effects of debriefing after operative childbirth; discussion on decision making and decision-to-delivery intervals. This chapter is concluded by different points on risk management in labour ward, mainly with potential interest of auditable standards and training with computer assisted simulation.
