La violence obstétricale est un phénomène généralisé qui porte préjudice à la santé maternelle dans le monde entier. L’OMS reconnaît que les soins maltraitants et non-respectueux dans les maternités est un facteur contributif à la mortalité maternelle et infantile, et la communauté internationale a pris des mesures pour tenter d’identifier et éradiquer toutes les formes de violences obstétricales. En Amérique Latine, l’Argentine a légiféré sur l’interdiction de la violence obstétricale.

Cette thèse a pour objet d’examiner le développement du concept de violence obstétricale en Argentine, son évolution organique (“organic evolution“) d’une réglementation et recommandation médicale à une législation nationale. Cette thèse rassemble des éléments sur le degré de succès permis par ce travail de définition, d’évaluation et et de législation sur la prévention des violations des droits des femmes, à la fois dans les pratiques et à travers les actions judiciaires.

Abstract (English)  :

Obstetric Violence is a pervasive phenomenon that affects women’s maternal health worldwide. It has been recognized by the WHO that abusive and disrespectful treatment in facility-based childbirth is a contributing factor in maternal and infant mortality, and the global community has adopted steps in attempting to identify and eliminate all forms of obstetric violence. Within Latin America, Argentina has taken proactive measures legislating the proscription of obstetric violence.

This thesis seeks to examine the development of the concept of Obstetric Violence in Argentina, its organic evolution from internal medical regulations and guidelines to national legislation. The thesis will also track evidence about the degrees of success that Obstetric Violence definition, assessment and regulation have had in preventing violations of women’s rights—both on a practical level and in the legal redress of these rights through tort claims.

Département de droit, Université de Toronto. Le travail porte sur l’Argentine. Il décrit notamment comment les organisations professionnelles se sont appropriées les standards nationaux : de façon incomplète. Il note aussi que du ministère de la santé rend compte du succès de ses actions sur l’humanisation des pratiques obstétricales, mais que les indicateurs utilisés ne correspondent pas à la réalité du terrain. Cette partie est intéressante car, bien que située dans le contexte d’un pays en particulier, elle montre le trajet à parcourir entre des standards nationaux ou internationaux et la réelle diffusion des pratiques dans les maternités.

L’autre partie du travail porte sur l’effet des recommandations médicales et de l’évolution des textes législatif au regard du droit. En fait, au travers d’unique cas de poursuite pour violence obstétricale, il décrit que les actes invasifs sans respect du consentement de la femme n’est pas retenu par les juges (il s’agissait de césarienne et épisiotomie). Le cas a uniquement traité sous l’angle de la faute médicale (épisiotomie non effectuée dans les règles de l’art)
