Cet article étudie les soins non-respectueux, maltraitants et violents en maternité, vécus par beaucoup en Afrique du Sud. Il considère ce phénomène sous l’angle des droits humains. Il soutient que les soins maltraitants intentionnels en maternité doivent être considérés comme de la violence obstétricale, qui une forme spécifique de violence de genre, et qu’ils doivent être criminalisés. Cette approche reflète une tendance émergente d’action contre les violence obstétricales à l’échelle internationale, et s’inspire de la criminalisation introduits dans les droits mexicains et vénézuéliens. Abstract (English)  :

This article examines the disrespectful, abusive and violent maternity care that many South African people face. It identifies this conduct as a human rights violation and argues that intentional abusive maternity care should be labelled as obstetric violence, a specific form of gender-based violence, and that it should be criminalised. This approach reflects a nascent global trend to act against obstetric violence, and draws inspiration from statutory crimes introduced in Venezuela and Mexico. Building on the Latin American experience, the article proposes how the current legal conception of obstetric violence should be further developed to suit the unique position of pregnant people in South Africa.

L’article est intéressant à plusieurs titres : revue de description du terme “violence obstétricale“ d’après diverses sources, dont des mouvements militants (Espagne) ; point sur les réponses apportés par les organismes et états : FIGO Guidelines, loi au Mexique et au Venezuela ; point sur les formes de violences, aussi appuyée sur une revue de littérature.

Pour l’auteur, il faudrait criminaliser la violence obstétricale (en Afrique du Sud), mais en faisant évoluer le concept :
- le limiter aux violences intentionnelles individuelles
- inclure non seulement les femmes, mais les jeunes filles et les personnes intersexuées (elle préfère parler de “pregnant people“)
- prendre en compte les autres aspects de la santé reproductive, pas seulement l’accouchement.

Violence obstétricale sous l’angle du droit, en Afrique du Sud. Décrit les lois d’Amérique Latine sur la violence obstétricale. Défend l’idée de lois pour l’Afrique du Sud.
