Résumé (français)  :

Le défaut ou l’insuffisance d’anesthésie pour césarienne est un motif de plainte en anesthésie obstétricale qui peut être à l’origine de préjudices physiques et psychiques aux conséquences non négligeables. Cet état de fait est illustré au travers de deux cas, le premier concerne une analgésie péridurale complétée dans le but d’obtenir une anesthésie pour une césarienne en urgence, le second relatant la réalisation d’une rachianesthésie dans un contexte programmé. Dans les deux cas, l’anesthésie était insuffisante, et les patientes en ont souffert. La responsabilité est parfois partagée entre l’anesthésiste et l’obstétricien, même si chaque praticien reste responsable pour ce qui relève de son domaine de compétence. Une faute est souvent retenue pour insuffisance des moyens mis en œuvre avec, entre autres, l’absence de décision de conversion en anesthésie générale. Les préjudices et leur hauteur sont discutés.

Abstract (English)  :

Inadequate anesthesia for caesarean delivery may cause distress to the patient and lead to complaints and medicolegal claims. This is illustrated with two cases, one related to augmentation of a labor epidural analgesia to anesthesia for urgent caesarean delivery, the other related to a spinal anesthesia performed in a nonurgent context. In both cases, inadequate anesthesia had caused severe distress to the patient. In obstetrical practice, liability is sometimes shared by the anesthesiologist and the obstetrician. A misconduct is often withheld, if ineffectiveness of measures implemented to solve the problem (conversion to general anesthesia) is demonstrated. How the sustained damage is appreciated and valorized is discussed.
