Aux États-Unis, les femmes sont systématiquement contraintes de subir des césariennes, des épisiotomies et l’utilisation de forceps, malgré leur souhait de tenter un accouchement vaginal naturel. Pourtant, le système juridique américain actuel ne fournit que peu de réparation aux femmes contraintes à certaines procédures médicales pendant l’accouchement. Les tribunaux et les médecins sont prêts à outrepasser le choix de la procédure d’accouchement d’une femme s’ils estiment que ce choix présente des risques pour le fœtus, et ils accordent peu de valeur au droit de la femme à l’autonomie corporelle. Cette note propose une solution pour traiter le problème des procédures médicales sous contrainte pendant l’accouchement en important un cadre créé au Venezuela et en Argentine, qui caractérise cette question comme « violence obstétricale ». Premièrement, cette note contient un aperçu des lacunes du cadre juridique américain existant pour résoudre le problème. Deuxièmement, elle explique les avantages du cadre de la violence obstétricale et fait valoir que son adoption aux États-Unis permettrait de remédier à de nombreuses défaillances du système existant. Et troisièmement, cette note présente quelques stratégies législatives et procédurales qui peuvent être utilisées pour mettre en œuvre ce cadre aux États-Unis et aborde brièvement certains des défis que ces stratégies peuvent poser.

Abstract (English)  :

In the United States, women are routinely forced to undergo cesarean sections, episiotomies, and the use of forceps, despite their desire to attempt natural vaginal delivery. Yet, the current American legal system does little to provide redress for women coerced to undergo certain medical procedures during childbirth. Courts and physicians alike are prepared to override a woman’s choice of childbirth procedure if they believe this choice poses risks to the fetus, and both give little value to the woman’s right to bodily autonomy. This Note proposes a solution for addressing the problem of coerced medical procedures during childbirth by importing a framework created in Venezuela and Argentina that characterizes this issue as “obstetric violence.“ First, this Note contains an overview of the shortcomings of the existing American legal framework to address the problem. Second, it explains the advantages of the obstetric violence framework and argues that its adoption in the United States would address many of the failures of the existing system. And third, this Note introduces a few legislative and litigation strategies that can be used to implement this framework in the United States and briefly addresses some of the challenges these strategies may pose.

Nos Estados Unidos, as mulheres são rotineiramente forçadas a submeter-se a cesarianas, episiotomias e uso de fórceps, apesar do desejo de tentar o parto vaginal natural. No entanto, o atual sistema legal americano faz pouco para fornecer reparação para as mulheres coagidas a se submeter a certos procedimentos médicos durante o parto. Tanto os tribunais como os médicos estão preparados para se sobrepor ao procedimento de parto da mulher se acreditarem que esta escolha representa riscos para o feto, e ambos dão pouco valor ao direito da mulher à autonomia corporal. Esta nota propõe uma solução para abordar o problema dos procedimentos médicos coercitivos durante o parto, importando uma estrutura criada na Venezuela e na Argentina que caracteriza essa questão como “violência obstétrica“. Em primeiro lugar, esta nota contém uma visão geral das deficiências do quadro jurídico americano existente para resolver o problema. Em segundo lugar, explica as vantagens da estrutura da violência obstétrica e argumenta que sua adoção nos Estados Unidos resolveria muitos dos fracassos do sistema existente. E terceiro, esta nota introduz algumas estratégias legislativas e de litígio que podem ser usadas para implementar essa estrutura nos Estados Unidos e aborda brevemente alguns dos desafios que essas estratégias podem representar.
